Important Notice: FamSynch is a family logistics and intelligence application. It is NOT a medical record system, legal advice service, child-welfare authority, or licensed counselling service. Information you record in FamSynch is for your family's own coordination purposes only. FamSynch does not verify, endorse, or take responsibility for the accuracy of family-supplied information. For medical, legal, or child-safety matters, consult a qualified professional or contact the relevant authority directly.
By using FamSynch, you acknowledge that you have read, understood, and agreed to this notice.
1. Agreement Between You and Us
This Agreement ("Terms of Service" or "Terms") is a legally binding contract between:
You ("User", "you", "your") — the individual using FamSynch.
Us — FamSynch, a mobile application based in Australia ("FamSynch", "we", "us", "our").
These Terms govern your access to and use of the FamSynch mobile application (the "App"), website, and all related features, content, and services (collectively, the "Services").
By downloading, installing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Eligibility
2.1 Age requirement
You must be at least 18 years old to create a FamSynch account.
Users aged 16–17 may use the Services as a teen-role member of an existing family only with the explicit consent of a parent or legal guardian who agrees to these Terms on their behalf.
FamSynch does not create individual accounts for children under 16. Children may appear as profile entries within a parent's family, but they do not log in or operate the app independently.
2.2 Legal capacity
You represent that you have the legal capacity to enter into a binding contract and are not prohibited by any applicable law from using the Services.
2.3 Geographic availability
The Services are available in selected countries via the Apple App Store and Google Play. Availability may change without notice. Use of the Services outside available countries is at your own risk.
3. Your Account
3.1 Registration
To use most features, you must register an account using a valid email address. You agree to:
Provide accurate and complete information.
Keep your information up to date.
Maintain the confidentiality of your account credentials.
Notify us immediately of any unauthorized access to your account.
3.2 Account security
You are responsible for all activity on your account. If you suspect your account has been compromised, change your password immediately and email us at support@famsynch.com.
3.3 One account per user
Each individual is permitted one account. Sharing accounts is not permitted and may result in account termination.
3.4 Family creator and family members
The user who creates a family in FamSynch is the family administrator. The administrator is responsible for the accuracy of the family member profiles they create and for any data they record about other family members. By recording another person's information in FamSynch, you confirm that you have the authority to do so (for example, you are the parent of a child you are adding, or you have the consent of another adult family member).
4. License to Use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Services for your personal, non-commercial use.
4.1 You may NOT:
Copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App.
Use the Services for any unlawful purpose or in violation of these Terms.
Attempt to gain unauthorized access to our systems, user accounts, or data.
Use any automated system (bots, scrapers, crawlers) to access or collect data from the Services.
Resell, sublicense, or commercially exploit any part of the Services without our written permission.
Remove or alter any proprietary notices, labels, or marks from the Services.
Use the Services to harm, harass, defame, surveil, or impersonate any person or entity.
Record information about another person in FamSynch without the lawful authority to do so (for example, surveilling an estranged spouse, recording a third party's calendar without consent).
Upload content that infringes intellectual property rights, privacy rights, or any other legal right.
Upload malicious code, viruses, or harmful content to the Services.
Use the Services to evade child custody, restraining orders, or other lawful restrictions.
4.2 Service changes
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any such modification, suspension, or discontinuation.
5. User Content
5.1 What is User Content
"User Content" means any content you upload, post, create, or share through the Services, including:
Family member profiles you create.
Calendar events (manual, screenshot-extracted, or Google-synced).
Screenshots you upload for AI extraction.
Family memory notes.
Chat messages to the FamSynch AI assistant.
Profile information.
Any other content you submit.
5.2 Ownership and license
You retain all rights, title, and ownership of your User Content.
By uploading User Content, you grant FamSynch a limited, worldwide, non-exclusive, royalty-free license to store, process, display, and use the User Content solely for the purpose of providing the Services to you. For example:
Your screenshots are processed by AI extraction and then auto-deleted from storage per the retention policy in our Privacy Policy.
Your events are stored so members of your family can see them according to the visibility you set.
Your chat messages are stored to maintain conversation context and improve the assistant's performance.
5.3 Visibility of your content
Family data is private to your family by default. Other FamSynch users outside your family cannot see your data.
Within a family, the per-event visibility model applies — an event you mark private is visible only to you; an event you mark busy is visible as a busy block to other family members; an event you mark shared is fully visible.
We do not sell, publish, or use your private User Content for AI training.
5.4 Prohibited content
You will not upload User Content that is:
Illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of privacy.
Infringing on any intellectual property, trade secret, or proprietary right.
Impersonating any person or entity, or misrepresenting affiliation.
In violation of applicable laws including the Indian Information Technology Act 2000, IT Rules 2011, or equivalent laws in your jurisdiction.
Containing viruses, malware, or harmful code.
Commercial content, advertising, or spam.
Content that promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Content that threatens national security or public order.
Information about a person obtained or recorded without authority (for example, calendar information of someone who has not consented to share it).
We reserve the right to review, flag, remove, or refuse any User Content that violates these Terms, at our sole discretion.
5.5 Content removal on account deletion
When you delete your account, your User Content is permanently removed from our active systems within 30 days, except where retention is required by law.
6. AI Features
FamSynch uses AI to extract events from screenshots, generate reminders, detect conflicts, and power the chat assistant.
Important limitations:
AI is NOT a personal assistant, a doctor, a nutritionist, a lawyer, or a child-safety professional.
AI responses are generated by language models and may contain errors, omissions, or hallucinations. Always verify important information before acting on it — for example, double-check an extracted event time before driving to a school pickup.
The chat assistant will decline questions about medical, legal, custody, or child-safety topics and refer you to a qualified professional.
Reminders are best-effort. FamSynch will not be liable for missed events, late pickups, or other consequences of relying on AI-generated outputs.
You acknowledge that AI features are provided "as is" with no guarantee of accuracy.
7. Connected Services
FamSynch offers optional integration with Google Calendar (read-only, opt-in per family member). When you connect a third-party service:
You authorize FamSynch to access the data described in the relevant integration's documentation and our Privacy Policy.
You retain full control to disconnect at any time via in-app Settings.
Connected-service providers (e.g., Google) have their own terms and privacy policies; you are responsible for understanding and complying with them.
FamSynch is not responsible for changes, outages, or modifications by the connected service provider.
8. Subscriptions and Payments
8.1 Free tier
FamSynch is free to download and use during the beta period. We may introduce paid subscription tiers at a future date.
8.2 Future paid tiers
If and when paid subscriptions are introduced, the following will apply:
All subscriptions will be billed and managed through Apple App Store or Google Play, according to their respective billing systems.
Subscriptions will renew automatically unless cancelled before the renewal date.
Cancellation can be performed via your Apple ID or Google Account subscription settings.
Refunds are processed by Apple or Google per their respective policies. FamSynch does not process refunds directly.
We will provide at least 30 days' notice of price changes.
9. Intellectual Property
9.1 Our IP
All content, features, and functionality of the Services (excluding User Content) — including but not limited to text, graphics, logos, icons, images, audio, code, design, trademarks, and compilations thereof — are the exclusive property of FamSynch or its licensors and are protected by applicable intellectual property laws.
9.2 Trademarks
"FamSynch" and any associated logos are trademarks of the operator. You may not use them without our prior written permission.
9.3 User-submitted ideas
If you submit feedback, suggestions, or ideas, we may use them without obligation to compensate you, attribute the source, or keep them confidential.
10. Disclaimers
10.1 Service provided "as is"
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No professional advice
THE SERVICES ARE NOT INTENDED TO PROVIDE MEDICAL, LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE. INFORMATION PRESENTED IN THE APP — INCLUDING REMINDERS, CONFLICT ALERTS, AND AI-GENERATED CONTENT — IS FOR YOUR FAMILY'S OWN COORDINATION PURPOSES ONLY. ALWAYS CONSULT A QUALIFIED PROFESSIONAL FOR HEALTH, LEGAL, OR SAFETY DECISIONS.
10.3 No guarantees on results
FamSynch does not guarantee:
That all events you upload will be extracted correctly by the AI.
That all reminders will be delivered on time.
That the connected calendar sync will catch every event without delay.
Continuous, uninterrupted, or error-free Service.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMSYNCH AND ITS OPERATOR WILL NOT BE LIABLE FOR:
Any indirect, incidental, consequential, special, punitive, or exemplary damages.
Loss of profits, revenue, data, use, goodwill, or other intangible losses.
Damages resulting from your use or inability to use the Services.
Damages resulting from missed events, late pickups, missed reminders, or family-coordination failures.
Damages resulting from any content posted by users or third parties.
Damages resulting from unauthorized access to your account or data.
Any safety-related, custody-related, or family-disagreement outcome associated with use of the Services.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AUD 100, WHICHEVER IS GREATER.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, the Australian Consumer Law).
12. Indemnification
You agree to indemnify, defend, and hold harmless FamSynch and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
Your use of the Services.
Your User Content, including data you record about other family members.
Your violation of these Terms.
Your violation of any third-party right (including intellectual property or privacy rights).
Your violation of any applicable law.
13. Termination
13.1 Termination by you
You may terminate your account at any time by deleting it via Settings → Privacy → Delete Account. Termination does not entitle you to a refund for unused subscription periods (subscription refunds are handled by Apple/Google per their policies).
13.2 Termination by us
We may suspend or terminate your account if:
You violate these Terms.
Your conduct is harmful to other users or to FamSynch.
You engage in fraudulent or illegal activity.
You use the Services to surveil, harass, or coerce another person.
Required by law.
Upon termination, your license to use the Services ends. Your User Content is deleted within 30 days except as required by law.
13.3 Survival
Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) remain in effect after termination.
14. Governing Law and Jurisdiction
14.1 Governing law
This Agreement is governed by the laws of Australia, without regard to conflict of law principles. For users residing in other jurisdictions, additional local consumer protection laws may apply, including:
India: Information Technology Act 2000, IT Rules 2011, Digital Personal Data Protection Act 2023, Consumer Protection Act 2019.
European Union: GDPR and applicable consumer laws.
United States (California): California Consumer Privacy Act, CPRA.
14.2 Dispute resolution
We encourage you to contact us first to resolve any dispute amicably. Email support@famsynch.com.
If a dispute cannot be resolved through negotiation:
The dispute will be submitted to the exclusive jurisdiction of the courts of Australia.
Subject to applicable local consumer protection laws that may grant you other rights to pursue claims in your local jurisdiction.
14.3 Class action waiver
To the extent permitted by law, disputes will be resolved on an individual basis. You waive the right to participate in class actions or representative actions.
15. Changes to These Terms
We may update these Terms from time to time. The updated Terms will be effective upon posting at famsynch.com/terms and accessible via the in-app Settings → Legal section.
For material changes, we will notify registered users via email or in-app notification at least 30 days before the changes take effect.
Continued use of the Services after the effective date of updates constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services and may delete your account.
16. General Provisions
16.1 Entire agreement
These Terms, along with the Privacy Policy, constitute the entire agreement between you and FamSynch regarding the Services.
16.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.3 No waiver
Our failure to enforce any provision does not waive our right to enforce it later.
16.4 Assignment
You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.
16.5 Language
These Terms are drafted in English. Any translation is provided for convenience only. In case of conflict, the English version prevails.
